Legal
Terms of use
Last updated 25 October 2026
These terms are a legal agreement between you and Retaged ("Retaged", "we", "us"). By creating an account or using Retaged you agree to them, so please read them carefully.
1. What Retaged is
Retaged is an online marketplace where people in the United Kingdom buy and sell pre-owned clothing, shoes, bags, jewellery and accessories, including desi and western wear.
We provide the website, a secure checkout, shipping labels and Buyer Protection. We are not the seller of any item. When you buy an item, your contract of sale is directly with the seller, not with us. We do not own, inspect, store or ship items, and we do not guarantee that any item, description or user is genuine, safe or legal, except as set out in our Buyer Protection policy.
2. Your account
- You must be 18 or over and live in the UK.
- Give accurate information and keep it up to date. One account per person.
- Keep your password secret. You are responsible for everything done with your account. We recommend turning on two-step verification.
- Tell us straight away if you think someone else has accessed your account.
3. Private and business sellers
Retaged is for private individuals selling their own personal items. If you sell regularly to make a profit, buy items in order to resell them, or sell on behalf of a business, you are a trader under UK consumer law. Traders must contact us before listing. We may not currently support business sellers, and traders who pose as private sellers may have their accounts closed.
Because most sales on Retaged are between private individuals, the Consumer Rights Act 2015 and the 14-day cancellation right for online purchases from businesses do not usually apply to the item itself. Sellers must still describe items accurately, and our Buyer Protection gives buyers a way to get their money back if something goes wrong.
4. Listing an item
When you list an item you promise that:
- you own it, have the right to sell it, and have it in your possession;
- your photos are of the actual item and were taken by you or with permission;
- the description, size, condition and any faults are accurate and honest;
- it is genuine. Counterfeit, replica or "inspired by" branded goods are not allowed;
- it is not on our Prohibited items list and is legal to sell in the UK;
- any item described as gold, silver or platinum meets UK hallmarking law.
You keep ownership of your photos and text. You give us a free, non-exclusive, worldwide licence to host, display, resize and use them to run and promote Retaged (including in social media and advertising) for as long as they are on Retaged and for a reasonable time after.
We may edit the category of, hide or remove any listing, at any time, if we reasonably believe it breaks these terms or the law.
5. Buying
Before you pay you will see the item price, the Buyer Protection fee (£0.80 plus 6% of the item price, up to a maximum of £25.00) and the postage cost. The contract of sale between you and the seller is formed when your payment is confirmed.
Payments are processed securely by Stripe. Retaged never sees or stores your full card details. Always pay through Retaged checkout: payments made any other way (bank transfer, PayPal, cash) are not covered by Buyer Protection, and asking for or offering them breaks these terms.
Offers: a buyer may offer a lower price where the seller allows it. When an offer is accepted, the buyer agrees to pay that price and the seller agrees to sell at it, and the item is held for the buyer for a limited time. If the buyer doesn't pay in time, the offer ends and the item goes back on sale. We may limit, cancel or expire offers, for example to prevent misuse.
6. Fees
Listing and selling is free. Buyers pay a Buyer Protection fee of £0.80 plus 6% of the item price, up to a maximum of £25.00 on each order, plus postage. We may change our fees by giving at least 14 days' notice on the site. Changes never affect orders already paid for.
7. Posting an item you've sold
Sellers must post the item within 5 days of payment using the prepaid label from Retaged, packed well enough to arrive undamaged. Keep your proof of postage. If you don't post in time, the buyer can report it and we may cancel the order and refund the buyer.
Couriers are independent companies, not part of Retaged, and delivery times are their estimates. If a parcel is lost or damaged in the post, we decide what happens to the money for that order based on the tracking, the proof of postage and how the item was packed, and we may claim from the courier.
8. How sellers are paid
Sellers must set up payouts with Stripe, which verifies identity and holds bank details. By doing so you also agree to the Stripe Connected Account Agreement. Money for a sale is held until the order completes: when the buyer confirms everything is fine, or automatically 2 days after delivery if the buyer raises no problem.
We may hold or delay a payout while a problem is investigated, or if we suspect fraud, a breach of these terms, or a chargeback. If a buyer is refunded because of a seller's breach (for example the item wasn't as described or wasn't posted), we will not pay that seller for that order, and we may recover any amount already paid to them, including any return postage. If a buyer disputes a payment with their bank (a chargeback), we may share order details with Stripe and the bank to respond, and hold the related payout until it's resolved.
9. Problems and disputes
Buyers must report any problem from their order page within 2 days of delivery, or if the item hasn't been posted within 5 days of payment. We will look at the evidence from both sides (such as photos, messages and tracking) and decide whether to refund the buyer, in full or in part, or pay the seller. Please send any evidence we ask for promptly: we may decide based on what we have.
Our decision settles what happens to money held by Retaged. We are not a party to the sale and don't act as a judge between buyer and seller beyond that. It does not take away any legal rights buyers and sellers have against each other.
10. Rules of conduct
You must not:
- harass, threaten or discriminate against anyone, or post offensive content;
- try to take payment or arrange a sale outside Retaged, or share contact or bank details to do so;
- commit or attempt fraud, leave fake reviews, or use more than one account;
- copy, scrape or misuse the site or other users' content, or interfere with how it works;
- infringe anyone's copyright, trade marks or other rights.
To keep people safe, our team may review messages, listings and orders, for example when something is reported or looks like fraud.
11. Suspending or closing accounts
We may warn you, remove content, limit your account, hold payouts or suspend or close your account if we reasonably believe you have broken these terms or the law, or to protect other users or Retaged. Where it is safe and lawful to do so, we will tell you why. You can close your account at any time by contacting us. Orders already in progress must still be completed.
12. Our responsibility to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
Apart from that:
- we are not responsible for what users do, say, list, sell or buy, or for the quality, safety, legality or authenticity of items, except under our Buyer Protection policy;
- Retaged is provided "as is". We work hard to keep it running and secure, but we cannot promise it will always be available or error-free;
- we are not liable for any loss that was not reasonably foreseeable, or for any loss of business, profit or opportunity;
- we are not responsible for delays or failures caused by things outside our reasonable control, such as courier, payment provider, hosting or internet problems;
- we may change, pause or stop any part of Retaged (for example a feature or payment method). If we close Retaged, we'll give reasonable notice and complete or refund orders already paid for;
- our total liability to you for anything arising from your use of Retaged is limited to the greater of £100 or the total fees you paid us in the 12 months before the claim.
13. If you break these terms
If you break these terms or the law, you are responsible for the reasonable losses, costs (including reasonable legal costs) and claims that you cause us or other users, for example from listing counterfeit goods or misdescribing an item.
14. Tax and reporting to HMRC
You are responsible for any tax due on your sales. Under the UK reporting rules for digital platforms, we may be required to collect information from sellers (such as full name, address, date of birth and National Insurance number or tax reference) and report sellers' sales to HMRC. This usually applies to sellers who make 30 or more sales, or earn around £1,700 or more, in a calendar year. We may restrict selling until we receive the information we need.
15. Reporting illegal content or infringement
If you believe a listing or message is illegal, counterfeit or infringes your rights, use the Report button on the listing or profile, or email us at retaged2026@gmail.com with the link and the reason. We will review reports promptly and decide whether to remove content. We don't tell the person reported who reported them, unless the law requires it.
16. Changes to these terms
We may update these terms, for example when the law or our service changes. For important changes we will give you notice on the site or by email before they take effect. If you keep using Retaged after that, the new terms apply. If you don't agree, you can close your account.
17. Law and courts
These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales, but if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
18. General
- These terms, together with the policies linked from them (Privacy, Buyer Protection, Prohibited items, Community guidelines and the others in our footer), are the whole agreement between you and us about using Retaged.
- If a court decides part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- We may transfer our rights and duties under these terms to another organisation, for example if Retaged is sold; this won't reduce your rights. You may not transfer yours without our agreement.
- Only you and we have rights under these terms; nobody else can enforce them.
